About the Promotion
1. This Promotion is offered by Employment Hero Pty Ltd (ABN 11 160 047 709) (Employment Hero).
2. As set out in these Terms & Conditions, this Promotion provides the opportunity for an Eligible Participant to receive a Reward (Promotion).
3. This Promotion will take place from 09:00, 1 May 2024 to 23:59, 31st May 2024 (Promotion Period).
Who can enter?
4. Users with Swag accounts that have not opened a Swag Spend Account or used the Cashback feature in the Swag app more than once (Eligible Participant).
How to enter?
5. To win the Reward (550 Hero Points), you must:
(a) have the Swag app already downloaded at the start of the Promotion Period;
(b) create a Swag Spend Account within the Promotion Period; and
(c) complete a cashback transaction valued at over AUD $10 via the Swag app within the Promotion Period.
6. You can win a Bonus for each action by:
(a) completing 3 Cashback transactions over AUD $10 via the Swag app within the Promotion Period (150 Hero Points); and/or
(b) switching your energy provider to ENGIE via the offer made available to Eligible Participants in the Bills tab of the Swag app within the Promotion Period (2000 Hero Points).

- successfully sign up as a customer of ENGIE by redeeming the ENGIE offer for the first time through the Swag app;
- meet the eligibility criteria set by ENGIE and receive approval from ENGIE to be a customer that receives an energy plan from them; and
- be a billable customer of ENGIE for at least 30 days.
Reward
7. Every Eligible Participant who completes the challenge actions under clause 5 within the Promotion Period will receive 550 Hero Points (Reward) by July 31st 2024.
Bonus
8. You will have the opportunity to win up to 2150 Hero Points (Bonus) for the actions identified under clause 6.

10. This Promotion is managed in accordance with the Employment Hero Privacy Policy.
Liability
11. Except for any liability that cannot be excluded by law, Employment Hero (including its officers, employees and agents) excludes all liability (including negligence), whether direct, indirect, special or consequential, for any loss or damage arising in connection with this Promotion, including any:
(a) technical difficulties or equipment malfunction (whether or not under Employment Heroโs control);
theft, unauthorised access or third party interference;
(b) entries that are late, lost, altered, damaged or misdirected (whether or not after Employment Hero receives it) due to any reason beyond Employment Heroโs reasonable control;
(c) variation in Reward value to that stated in these terms; or
(d) tax liability incurred by an Eligible Participant.
General Terms
12. The Reward or the Bonus is not transferable to any other products or cash.
13. The Reward is granted โas isโ and Employment Hero does not provide a warranty of the Rewardโs merchantability, or fitness for a particular purpose.
14. Employment Hero reserves the right to terminate the Promotion early in full or in part at its absolute discretion.
15. Laws may apply to you or to Employment Hero as a result of your specific location. If this is the case, and if those laws are inconsistent with any part of these terms, those laws will prevail to the extent of the inconsistency.
16. Severability: If any part or provision of these terms are invalid, unenforceable or in conflict with the law, that part or provision is replaced with a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remainder of these terms will be binding on the parties.
17. Governing Law: These terms are governed by the laws of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of its courts.
