Refer a suitable candidate to a job on Swag Jobs, and if the candidate becomes a successful referral, then the Referrer and the Referred Candidate can both receive a Reward of $50. You will only be paid the Reward if you meet the criteria in these Terms and Conditions, so please keep reading to find out how the Promotion works.
About the Promotion
1. This Promotion is offered by Employment Hero Pty Ltd (ABN 11 160 047 709) (Employment Hero).
2. As set out in these Terms & Conditions, this Promotion provides the opportunity for you to receive the Reward during the Promotion Period (Promotion).
3. The Promotion is available to you if you satisfy the necessary criteria under these Terms and Conditions before 5:00pm, 30 June 2023 (Promotion Period).
Who can enter?
4. The Promotion is open to Swag users who refer a candidate for a job posted on Swag Jobs (Referrer) or a candidate who applies for such a role based on a referral (Referred Candidate) during the Promotional Period.
How to qualify for the Promotion?
5. To qualify for this Promotion you must be a Referrer in satisfaction of the conditions in clause 5(a), or a Referred Candidate in satisfaction of the conditions in clause 5(b).
a. You will qualify for this Promotion as a Referrer if the following conditions are satisfied:
- i. you must refer the Referred Candidate to an active role on Swag Jobs;
- ii. the Referred Candidate must successfully apply for the referred role and enter into an employment agreement with the job poster of the role for which the referral was made;
- iii. you must set up a Swag account and a Swag Spend Account via the Swag app within 30 days of the conditions in clause 5(a)(i) and (ii) being satisfied; and
- iv. you and the Referred Candidate must each be an Australian resident.
b. You will qualify for this Promotion as a Referred Candidate if the following conditions are satisfied:
- i. you are referred to an available role on Swag Jobs by a Referrer;
- ii. you successfully apply for the referred role and enter into an employment agreement with the job poster of the role for which the referral was made;
- iii. you must set up a Swag account and a Swag Spend Account via the Swag app within 30 days of the conditions in clause 5(b)(i) and (ii) being satisfied; and
- iv. you and the Referrer must each be an Australian resident.
Reward
6. If you satisfy the conditions provided in clause 5(a) or 5(b), then you will be entitled to receive AUD $50 into your Swag Spend Account from Employment Hero (Reward).
7. The Reward will be confirmed by Employment Hero and paid into your Swag Spend Account within 40 days of execution of the employment agreement referred to in clause 5(a)(ii) and 5(b)(ii).

8. The Employment Hero Platform Terms and Conditions and Privacy Policy (available here) apply to this Promotion.
Liability
9. Except for any liability that cannot be excluded by law, Employment Hero (including its officers, employees and agents) excludes all liability (including negligence), whether direct, indirect, special or consequential, for any loss or damage arising in in connection with this Promotion, including any:
- a. technical difficulties or equipment malfunction (whether or not under Employment Hero’s control);
- b. theft, unauthorised access or third party interference;
- c. entries that are late, lost, altered, damaged or misdirected (whether or not after Employment Hero receives it) due to any reason beyond Employment Hero’s reasonable control;
- d. variation in Reward value to that stated in these terms; or
- e. tax liability incurred by you.
General Terms
10. The Reward is not transferable to any other products or cash.
11. Employment Hero reserves the right to terminate the Promotion early in full or in part at its absolute discretion.
12. Laws may apply to you or to Employment Hero as a result of your specific location. If this is the case, and if those laws are inconsistent with any part of these terms, those laws will prevail to the extent of the inconsistency.
13. Severability: If any part or provision of these terms are invalid, unenforceable or in conflict with the law, that part or provision is replaced with a provision which, as far as possible, accomplishes the original purpose of that part or provision. The remainder of these terms will be binding on the parties.
14. Governing Law: These terms are governed by the laws of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of its courts.
